ASHEVILLE CONCRETE & DRIVEWAY —
TERMS AND CONDITIONS
1. Definitions
“Contractor“: Asheville Concrete & Driveway, located at 742 Haywood Rd, Asheville, NC 28806.
“Client“: The individual(s) or entity purchasing services for the designated project address.
“Project“: Concrete driveway installation, repair, or replacement services detailed in the attached proposal.
2. Scope of Work & Change Orders
Standard Scope: The Contractor will execute the services specifically outlined in the project proposal.
Modifications: Any changes, additions, or deviations from the original scope requested by the Client must be executed via a written Change Order signed by both parties. Change Orders may adjust the total cost and estimated completion timeline.
3. Scheduling & Delays
Timeline: Project start and completion dates are estimates established upon mutual agreement.
Unforeseen Delays: The Contractor will make reasonable efforts to maintain the schedule, but is not liable for delays caused by inclement weather, site access issues, permit delays, or supply chain disruptions.
4. Payment Terms & Schedule
Deposit: A deposit of 50% of the total project cost is due upon contract execution to secure materials and scheduling.
Final Payment: The remaining 50% balance is due immediately upon completion of the concrete pouring stage.
Accepted Methods: Payment must be made by cash or check as specified on the invoice.
5. Cancellation & Refund Policy
In the event the Client cancels the project after paying the initial deposit:
A cancellation fee equal to 20% of the total project cost will be assessed to cover administrative overhead, planning, and reserved resources.
If the deposit exceeds the 20% fee, the remaining balance will be refunded to the Client within 14 business days of receiving written cancellation notice.
If the deposit is less than the 20% fee, the full deposit will be retained, and the Client agrees to pay the remaining balance of the fee immediately upon cancellation.
6. Site Conditions & Client Responsibilities
Access: The Client must ensure the site is clear, unlocked, and fully accessible before work begins.
Permits: The Contractor will obtain all required municipal permits; the Client agrees to provide reasonable assistance and documentation if requested.
7. Warranty & Disclaimers
Coverage: Workmanship and materials are warrantied for one (1) year from the completion date.
Exclusions: This warranty strictly covers structural and material defects. It excludes minor surface hairline cracking, spalling from de-icing chemicals, normal wear and tear, ground settling, or damage caused by heavy vehicles exceeding standard driveway capacity.
8. Liability & Governing Law
Indemnification: The Client agrees to indemnify and hold harmless the Contractor against claims, damages, or expenses arising from the use of the driveway post-completion.
Termination: Either party may terminate this contract via written notice in the event of a material breach by the other party.
Jurisdiction: This contract is governed by the laws of the State of North Carolina and Buncombe County.
Entire Agreement: This document constitutes the full agreement between both parties and supersedes all prior written or oral agreements.
